Less mush from ILOAT…

Mise au point

The views reflected in the contribution on the ILOAT in the UN Special of May 2004 were those of the author and not of the Editor of the magazine. Various readers objected to the interpretation of the case related to WIPO and pointed out relevant parts of the judgement inter alia dismissing the substance of the case, for example: «this does not mean that it will allow the complainant’s claim for re-instatement, which in the view of the circumstances of the case, including events that occurred after the impugned decision, would appear particularly inappropriate.» The evidence against the appellant according to the Tribunal was «weighty».
